It's not about common sense, it's not about the question if it's a copyright violation or not, the question is if Facebook THINKS it's a copyright violation.
Maybe they would be wrong, but with an army of lawyers, this fact is neglegtible. If you are a multi million or even billion dollar company, you are right if you say you are right.
