vehicle seizures usually take place due to drug busts and thats a special and specific piece of legislation that allows that.

Hell, even in a vehicular homicide case, the defendant gets the car back unless it's his second DWI (DUI) ...at least here in NY, as far as I know.
Ray, Cars are also taken from "john's" looking for 20 dollar blowjobs. If the vehicle is continually used in the commission of a crime, and is in fact the only reason the crime can be committed it will be seized.

Right or wrong the justification is there to take it. Property in a seizure becomes it's own entity and it's guilt or innocence is not tied to the human being charged. The state attorneys will make it to expensive to even attempt to recover.
