What would make that illegal? He isn't exactly accepting applications, conducting interviews, and hiring employees. He wants one person (a partner of sorts), in this instance I believe he can discriminate as much as he pleases.
Please give me an instance where a company or business man went on search for a "partner" or someone who would be working closely with them, who DID NOT discriminate? Yeah, let them just accept any tom, dick, and harry who responds. This would ensure the failure of the new venture. You have to discriminate to some extent in certain situations.
If this were a call center, and you were denied because of age, race, etc, it would be a different story. However this is GFY so
