Besides the obvious, if the tape has audio, the guy is screwed. Hawaii is a two party consent state. That means that all parties have to consent to the recording of audio. It is a class C Felony. More importantly, in addition to fines and jail time, the statute in Hawaii calls for the surrender of all profits gained from the illegal recording.
