Yes it is, but it's not because someone is gay or black. The death penalty is used for extremely violent criminals in extreme cases. I am torn on the death penalty issue as I don't necessarily agree that a government should take the life of someone. However, when I hear of a man rape and bury a 6 year old girl alive, it's kind of hard not to wish for some justice.

I used to believe in the death penalty. You kill someone, and we kill you back. Simple.
But that's letting them off easy. Instead, we should lock them up in a cold dark damp cell with no light, no anything including no mattress or bedding, and never ever allow them out of that cell until they die of natual causes.
