Basically, 16 year old asian-american girl gets her picture taken by a friend. The friend post it to flickr, which effectively puts the image into the public domain. Virgin in australia uses part of the image in an ad campaign.

Now (you guessed it) the parents are suing.

What do you think?
I think a good lawyer would need to work all that shit out. At least 2 different countries involved. PERSONALLY, I don't think it's right for Virgin to use a public domain (and we all know how much we hate those two words) picture as an ad.

Not charging Virgin sets a very dangerous precedent, IMO.
