Your content isn't on the site. A file with links to people elsewhere who have 'your' content is the only thing there. This is your #1 problem. If the content was hosted and indexed on the site, you'd get them closed. Unless it's a company as big as Rapidshare, somehow the law doesn't apply to them....I wonder what their secret is? ;)
First of all, the domain name isn't necessarily registered to the person who owns the site, so the WHOIS can be quite useless.
Secondly, 'Hiding in the dark' just happens to be a very effective strategy to not being identified. If you can't be identified, then you can't be found. If you can't be found, you can't be threatened. If you can't be threatened then there's no incentive to stop.
