The location of the actual site, webmaster(s), owner(s), does not matter. It is true that it is more difficult for authorities to shut down sites in some countries but it is not impossible. We do work with law enforcement agencies including the F.B.I. These law enforcement agencies will share information with their counterparts in other countries and in some cases even coordinate their efforts. Many of you may already be aware that under the current Child Pornography Laws nudity does not always equal pornography. In other words regardless if a child is nude, partially nude or fully clothed, this is not as important in determining if it is cp as what the child is doing and/or having done to them. If the image is lewd or sexual in nature then chances are it is child pornography.
This "loophole" exists to protect legitimate artists such as David Hamilton. For those of you who don't know who David Hamilton is, he is a world renowned photographer who specializes in artistic child nude photographs. It also exists to protect everyday people who may want to take an innocent picture of their child in the bath tub and share it with family and friends through email or on the family website. Unfortunately there has been a growing number of websites over the past few years that are exploiting this loophole. They call their sites "artistic" in nature and contain legal disclaimers and warnings for child predators to "stay out". These site owners have retained the services of lawyers to evaluate their content to ensure compliance with uscode/18/2256. In reality everyone knows that the people purchasing memberships to these sites are not art lovers.
All that being said we at ASACP do report these sites if we know the authorities are not already aware of the site or if we feel there is any question as to the sites legal status. Because many of these sites do operate within the law they advertise heavily via spam email. The authorities and ASACP receive numerous reports regarding these sites. Rest assured that the authorities are aware of a great many of these sites and do act against them if they feel they can prosecute.
We do encourage anyone who feels they have seen an illegal child pornography site to report it to us. Even if you are not sure what you saw was child pornography it is best to err on the side of caution.
