There are many in the industry who believe that producers like Rob Black and Max Hardcore deserve whatever they get and bring the industry into the feds radar. I used to be one of them. Now I'm thankful that they're standing up to the authorities because if THEY lose, what's next? Interracial? Gangbangs? Gay? It could be something that WE as an industry may deem entirely acceptable, but those OUTSIDE see as obscene. We'd get no sympathy because in their eyes, WE'D be getting what WE deserve.
The definition of obscene is simply too vague because if you put 10 people in a room, you could very well get 10 different answers. If you put the same 10 people in a room, they could all tell you what constitutes murder though...unless of course one of them is a lawyer. (edit-how can a judge give instructions about what's obscene to a jury?)
Community Standards is even more ridiculous. So one day your community deems what we do as acceptable. Then a bunch of the hardcore moral majority move into your neighborhood and it's all of a sudden illegal??
One reason you'll never see a black and white scenario on the books is because the lawyers wouldn't allow it...not even the ones on our side. If they did, they'd be out of work. We'd all know what we could and couldn't do and wouldn't need a high priced attorney on retainer who can spew nothing more than his INTERPRETATION of the law.
