Hosting companies (at least some of them) might have a vested interest in keeping the "other team" on the net, because that is where they make their money. I am sure most of them don't and would be very cooperative, but I can imagine that some of them make their money in less than honest ways.

Basically, keep out the special interests and third parties, as they are the ones most likely to end up on the receiving end of DMCAs and whatnot in the long run.
