the laws suck..
in these cases the outcome is never good because the law is stuck, he has to be charged with manslaughter unless he knew his actions would cause death. If the guy is ultra stupid and doesnt realise he could kill the child then they have no choice but to charge him with a lesser crime than murder
the judge has the option though to disregard the usual punishment though and throw the book at him i believe .
