Steve, if you have content that is stolen and is showing up high in Google, go straight to the horse's mouth.

Getting pages/sites banned in Google is much easier then going to court and fighting over the logistics of where the content is hosted. Google usually just doesn't want to deal with it and pulls the site from their index.
