That would not prevent someone from sueing you for using their image for profit without a release. These are not 'public personalities' where you might have some defense. These are private individuals and they have a right to the use of their image. Just as importantlyk, anyone in the background of the shot would also have a case.

I'm not talking about releases in the sense of age verification, I'm talking about a person's right to the rights to their own image. Just being naked or topless in public does not change that right under copyright laws.
