Sagi, I would debate that long and hard. It may be legal taken in abstract, but considering that they provide access to stolen or pirated material (photoshop CS3, example, with a no-activation mod) makes them very, very marginal indeed.
Without going too far, I think a case could be made that they are part of a conspiracy to distribute stolen software. However, at this point, because the collective governments aren't doing very well at taking out P2P as it stands, it is unlikely they will go this route any time soon.
It isn't just what is "legal because nobody has a judgment against it yet" and doing what is right. Locating an AFF or Adbrite advertisement on a website always makes me wonder what the site is really up to.
