Not sure how you can draw the conclusions that you have drawn about what I said but I'll chalk that up to you misunderstanding my point.
How many designers you know have the resources or knowledge to mount a court challenge to someones actions?
The blame has to lie somewhere. If a designer is paid $2 for work that was resold for $2000 - it's the intelligence of the designer at fault.
On the other hand....If a design broker fails to pay a designer (which is the worst possible business practice) - that designer has many options..outing them on the webmaster forums...ICQing all their clients and giving them the 411, etc, etc....yet these options amount to little more than libel since the only course of action one should take in such a situation is through the courts, after all, the foundation of our society is based on accepted codes and laws.
Designers are creative types. Brokers are usually Business types. In a self-policed industry, obviously the bad apples will be able to succeed - regardless of the complaints of those they have hurt. Therefore - weeding out the bad guys takes common sense - yet in the BLING BLING world of the adult biz - people see DOLLAR SIGNS before they see the implications of business agreements.
