for every case that torrent sites have won theres 2 that they have lost thats why they have been getting shutdown left and right. of course being illegal is proven in a court of law so many sites still operate only because they havent been charged yet. to say "torrent sites are legal " is silly as each site is different and operates under different circumstances.. ( likewise to say they are all illegal is also just as silly i suppose ) in the examples given .. they are illegal.
