Any contract is already broken Mike. There is no "deal" on anything.
The seller either has what they offer for sale or not - obviously not in your case. Don't matter about "brokers" or the Fairy Godmother - that is all irrelevant.
To be reasonable... sounds like you have been in contact already and given them some time. It's probably the 72 hour notice time or confirmation a refund has been issued. To allow for failure and a satisfactory response, prepare now to sue for recovery of funds immediately after the due date and don't forget to consider any reasonable damages a judge would accept - think in terms of any work you have done with the content and where this needs to be redone. (It's a waste of time letting crap drag on and it will prob just be a total irritant - it's better to use the sledgehammer and resolve it and move on).
