The judge may have shown predjudice if he didn't review all the facts of the negotiation.

I'm more inclined to think the real kicker will be whether or not the judge is using threat of contempt to force a settlement.
That's a big no no although i'm not sure if it would apply in this case given how preliminary negotiations went.
