I don't think those are comparable cases. Your examples are blatant theft, connecting to P2P networks that already exist is not. BaDoink didn't host any illegal content nor upload any themselves to the network, they just had one button in their app that let people connect to other networks.
When they saw people didn't like that, they removed it.
I don't think it's the same comparison at all to Zango/Guba
