The answer would be self evident to anyone who had actually read the Constitution recently.
"Section. 8. The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;"
The Constitution empowers the legislative branch specifically to create legislation for "the general welfare." Therefore.. and I know it sucks to be you right now.. every social program (unless ruled unconstitutional by the Judicial) is created via Constitutional mandate.
