Here's the deal. At the time this happened ( a little over 2 years ago ) he was 17 and she was 15 and in the state of Georgia there was a law on the books that said if teenagers that are less than 2 years apart in age have sex it is a misdemeanor, however if they have oral sex it is a felony.
He was at a party where a girl had sex with another guy on camera while she was drunk and when she woke up she knew she was in trouble so she lied and told her family she was raped. The tape proved otherwise and those charges were dropped, however, they also had this kid on video getting the blowjob so there was no way for him to argue that it didn't happen. They decided to prosecute under this old law because they said that since she was 15 she was under the age of consent which is 16 in that state. they got the conviction. Little did anyone know this conviction came with a mandatory 10 year sentence. So he went off to jail.
After this all happened the state changed the law, but didn't make it retroactive so he was stuck in jail. Now that he is in the system, it's going to be very difficult to get the result thrown out. It looks like his best bet now is to try and make this a federal case and say that this law and case violates his basic civil rights so they can move up to a federal courts.
All in all it's a fucked up situation.
