The .xxx Top Level Domain

Overview

The .xxx Top Level Domain (TLD) has been proposed for responsible members of the online adult entertainment industry and those that supply products and/or services to it (the Online Adult Community). Only Members of the Community will be eligible to register .xxx domains that resolve (that is a name that Internet users can type in and have their computer display a Web site). ICM Regis-try (ICM) will offer individuals and entities that are not Members of the Community, an opportunity to register non-resolving domains if such registrants are concerned about potentially abusive registration.

A separate non-profit oversight body, the International Foundation for Online Responsibility (IFFOR) will work with the stakeholder community to develop a code of practice applicable to all registrants. The code will address practices such as unfair, deceptive, or fraudulent marketing practices; the use of malware, malicious code, spoofing, phishing; practices designed to attract children or suggest the presence of child pornography; unauthenticated use of credit cards; violations of law regarding the sending of unsolicited promotional email; or misuse of personal data. Registrants will be expected to participate in a simplified labeling program operated by the Internet Content Rating Association (ICRA) that identifies their site as an adult entertainment site.

Current status of .xxx application

On 10 May 2006, the ICANN Board rejected a draft contract governing ICM’s operation of the .xxx TLD. We have scrutinized the reasons given by Board members for making the decision and are satisfied that the principal concerns expressed (including ICANN having greater liability if it were to pass the application) are unfounded. Accordingly, we are continuing to address those concerns in order to obtain approval of a revised contract.

We are hopeful (but of course cannot guarantee) that these efforts will prove successful and will lead to the introduction of the .xxx Top Level Domain. We have invested a lot of time and effort into this initiative and are determined to see it through to completion.

Start up plan

The proposed contract describes ICM’s start up plans in advance of general registration. ICM intended to roll out the plan elements following contract approval, with general registration commencing approximately 6 months later. In order to provide an orderly process for members of the registrant community in the event of ICANN approval, and to use our resources effectively during this appeal period, ICM has decided to undertake the first phase of the plan (the “Industry Reservation” period) now.

Disclaimer

ICANN has not approved the .xxx domain, and may not do so in the future. Furthermore, the final terms, if any, on which the .xxx domain shall operate will be subject to further discussion with ICANN. Accordingly, ICM will offer industry members the opportunity to submit reservation requests free of charge.
