In truth i dont think the guy should be in jail , he did what every red blooded american college kid see's on spring break , he just recorded it for those who have never exp[erinced it themselves or want to remember..
On the other hand if we are all playing by the same book of rules then something is wrong here..
Do we want hard rules with no regard to context or bendable rules that people occasionally get railroaded .. ( assuming we cant have a perfect system lol )
In context what he did wasn't so bad.. but if the courts use that excuse they must also use the same rational when dealing with similar non-multimillionaire defendants , sadly this isnt the case.
