SEO Elite will not get you banned...That said, yes, using it or any other tool will probably get you banned. Why?
If you're like most webmasters, you'll take a "Manuals? I don't need no stinkin' manuals!" approach to learning how to actually use the software. You'll fart around with it with grand visions of thousands of visitors flooding your site and dive right in..."learning" all you need to know in a hour or less before implementation.
Over the next few weeks you'll "try this" and "try that" feature of the program, picking the ones you like best (and the ones you like best will be the ones that seem familiar or easy to understand...since you have no real idea what they actually do).
You'll make those primary features you liked the main reason you use the program with the mindset that you've got the inside track to becomming king of SEOland with this nifty secret tool.
So, following the "if the only tool you have available is a hammer, you'll approach everything as a nail" theory...Use this or any other tool as your "smoking gun" with SE traffic and you'll find yourself on the short end of the stick long term.
Personally, I don't agree with the "There is no money to be made in SEO" line of thinking. I think there's money to be made everywhere. I don't know and don't care what their definition (as in dollar amount) equals "no money" because that simply is not true.
Any singular approach can have the "There is no money to be made in..." added to the front of it. SEO (in and of itself) doesn't really exist, it is the end result of a unified approach to the promotion of your site. Cover your bases on a basic level in your niche (you and everyone else knows what are not good practice), you will become "relevant", traffic comes. It isn't overnight and no "quick fix" will produce long term results unless you have a sizeable budget with plenty of disposable 'testing' income.
From there you focus your efforts on staying relevant, not the never-never land of "SEO".
Full disclosure: I own the program, have & continue to use it. I've owned it for about 6 months now with no negative results from using the tool as it is intended, as have thousands of others. Not saying it's great, saying it's another tool.
