I'd talk to a lawyer, you'll certainly get better advice than here. Things in court work different than in real life, forget common sense, so I'd ask some expert.
If he's a broke ass and stays a broke ass (at least officially), you risk getting less than spending on a lawsuit, maybe just a "Cease and Desist" from a lawyer works better in this case...but I'm no legal expert.
