This by all means is trademark infringement & because the infringement is done with malicious intent, the case against them will be strong.. 2nd, note that if a scraper copies your text, they are violating copyright law which is also actionable in court..
3rd, because they are operating an affiliate program, one I am affiliate of, they are in violation of what is called Conflict of Interest Law.
