Well so far nobody has proved otherwise either. Maybe you guys should post something proving that you own the design (like a paid invoice), and don't owe payment on it. After all, that pretty design has been chillin right there on psd dot com for a few months now. How's business?
If your design company is soooo professional just change the design, and wash your hands of it. The damage seems to be done.
This is like an episode of Cops, where they arrest some guy and pull a bag of crack out of his pocket, yet he claims someone put it there and its not his, or his fault. Or those guys who get pulled over in a stolen car they just borrowed from a friend.
