You are missing the point entirely... and I suspect you realize it. Getting into the specifics of legal/not legal and debating semantics is nothing more than a smokescreen.
You are trying to come up with reasons not to oppose something which can only be damaging to everyone except the person profiting directly from it. That's nonsense from a business point of view and makes your defense personality motivated, not as you claim, the attacks on this kind of practise.
