"Spy" satellites are a long established and accepted form of intelligence gathering. Any country can deploy a satellite anywhere they want to in space. Arms limitation treaties even include provisions for displaying the destroyed arms (missles, big bombers, etc) in plain view so orbiting satellites can photograph them. Destroying another countries satellite is no different than sinking one of their ships on the high seas.
