my point was, since when is it illegal to sell a item that promotes a trademark? if he was to sell it, and that next person promoted the same thing, no harm no foul, right?

I promote jenna jameson's site, her name is trademarked, does that also mean I can't sell my jenna jameson domains? no, i don't think so

I guess I am kind of dumb to the law, but just because he owns a domain that contains a trademarked term, that means he can never sell it?
