In my opinion, I believe that the suit is without merit.
That being said...
I have known Tucker for a long time, I don't see him as being dishonest, not for a second.
That being said...
I don't believe Tucker was involved in the day to day operation of the program. I could be wrong, but I don't think I am. If there WAS dishonesty, I would bet that Tucker was not involved.
As to the NATS issue, I recall a conversation I had with NATS before we started using their software and I specifically asked, what happens if you go out of business? The answer as I recall was that a copy of the source code and a lifetime permanent license was on file with their attorney and that should that happen, all current licensees would receive them.
My memory could be wrong, but I am pretty sure that it is not.
