Can-Spam Attack Update

There is a newly developing trend in the Can-Spam area of litigation. Private parties are beginning to follow suit behind the DOJ and are using the Can-Spam Act to sue Affilliate Programs.

While the same legal issues arise, it is yet another reason why the adult industry must not roll over on these cases. Again, Robert Apgood and myself at Adultlaw.com are spearheading the defense of these cases.

Several affiliate programs have been sued by what apepar to be in my opinion "professional plaintiffs", similar to those persons who used the Federal anti-fax spam law to make money suing people for receiving one fax sheet of paper, unsolicited.

The law is not yet settled as to how far liaiblity for affiliates spam reaches. Does it reach to the Program? or others? tha that's what Mr. Apgood and myself are fighting in several cases right now.

If you have a Can-Spam issue, seek counsel. DOn't roll over.
