answer to this first part is:
1. What moron is gonna shell out for a tour design and not the content?
2. If the owner of the site is required to change or remove their tour because of content issues, that's their problem.

It's generally accepted by content providers that the content be licensed to the site owner, not the designer. The designer isn't reselling the content. The site owner is.
