Lindh adhered to the Taliban and rendered them aid, however they weren't the enemy when he offered his services. Finding him guilty of treason would necessitate that the government prove that he intended to harm America. There is no evidence that was the case.

And the alternative would be... start shrieking "He's a traitor!" anytime a discussion comes up, hoping that if you say it enough times people will believe it despite the lack of evidence? It certainly sells, just ask Rush Limbaugh and Ann Coulter.
