As far as the health arguement goes, they could say the same things about booze, fast food, sugar, caffeine, diet pills, etc. The problem with legislating against these behaviours is that it tends to push societry towards the direction that the super-conservative bible thumpers would like us to go.

According to the bible-thumper set: sex outside of marriage is bad for you, so is safer sex with multiple partners (even if your husband/wife is part of it), so is masturbating, and so on and so on. Do we really want to live in a world that is, while smoke-free, a highly pleasure-based-behaviour regulated place? If so, then throw democracy right out the window and bring us in some extremist Muslims to show us all the way!
