You do not have to be a spammer to get listed and spamhaus does not control everyones email. Only email servers using their block list are affected.
January 2005 topbucks had their server blacklisted for spamming, I found out my mail server was on the same subnet as them when some of my email bounced back. I asked spamhaus about it and they said that they ban entire subnets to keep spammers from moving from one set of IP's to another and if I did not like being banned then I needed to move my mail server to another host.
here is an email they sent me

So if host your site with an unscrupolous webhost who partners with spammers and CONTINUOUSLY IGNORES abuse reports, and you happen to be on an adjacent IP address, or subnet.....then you give a free pass to the Webhost and the spammer, and bitch about Spamhaus?
Kind of funny how dumb webnasters fail to research their Webhost of choice for abuse complaints. These hosts are often worse than the spammers themsleves, and have no problem fucking over the small, honest webmasters, while they get rich pocketing the big bucks the spammers pay them. Then everybody cries about the evil Spamhaus while the spammers and their complicit partners count their money......
