i think its a trademark on drawings , and sure you can
if you made a wal-mart smiley with the wal-mart logo and tried to sell it or use it in conjunction with making money . i think you would have a pretty good chance of being sued, although im not a lawyer and usually when it boils down to it , its always so fuzzy it never makes any "real" sense . lol
