Theo carefully constructed his post - as would be expected of any company making a public statement.

Proof/evidence - it seems like they are going to require overwhelming evidence that Media Revenue is banging cards intentionally. Media Revenue will have a hundred excuses, look at the response Paul got from the affiliate rep, everything but 'the dog ate my homework and then jumped up on the chair and turned the computer on and voila, somehow his little paws made some charges' - disproving those excuses falls on whose shoulders? I have seen a bunch of people suggest that these additional charges, which occurred AFTER the membership was cancelled, could be from 1 click upsells/upgrades. Bullshit, Paul from OnlyTease buys these memberships for the Porn Rewards surfers, they are in his name and with his email address. Paul isn't stupid enough to be clicking one click upsell mailers.

Chargebacks affect normal companies, not those which offset chargebacks with boatloads of fake prepaid credit cards signups. When you see "amazing ratios" posted you might want to factor things like that in.

Paul can also place another in a long line of complaints through the BBB and elsewhere. Would be amazed if there aren't ongoing investigations for multiple counts of fraud already.

Huge props to GFY/AVN on this.

Whether they are liable or not isn't the point, they still would have to eat legal costs associated with getting sucked in to the situation.

they can ignore the c&d, because of section 230 "safe harbour" provisions. Effectively, they are only a service provider, nothing more. There is plenty of case law out there to enjoy on the subject.

Of course, if mediarevenue feels that gfy staff had a hand in the thread, or somehow encouraged the posting, then the safe harbour would evaporate.
