Us (sex.com) and google got sued today

http://www.techfirm.com/yahoocomplaint.pdf. Good that they did not really name the company. If this complaint is right, no one can take casino ads.

Sethseekstruth 08-04-2004 10:55 PM

dang

BradM 08-04-2004 10:55 PM

This could be bad news Gary... hmmmm

Aly-Python 08-04-2004 10:56 PM

Gosh... Sorry to hear that one, Gary. Good luck with the suit.

psyko514 08-04-2004 10:59 PM

that's not a fucking lawsuit. that's a novel.

BRISK 08-04-2004 11:00 PM

This will be interesting to see what the outcome is. Please keep us updated.

KC 08-04-2004 11:00 PM

To Summarize...

Some guy from Scotts Valley, CA lost $100K by gambling online and he doesn't want to pay.

He accepts no responsibility for his actions and instead is blaming the search engines.

What a Dipshit.

The USA has always been a bit bizarro about online casinos all along... so nothing surprises me about this.

KC 08-04-2004 11:02 PM

On the bright side Gary, at least he grouped you with the big boys!!!

You know you've made the big time when you get named in a suit with Yahoo! and Google ;)

SleazyDream 08-04-2004 11:04 PM

It's almost as bad as paying $0.80 for a fresh cup of coffee - spilling it on your lap and then suing McDonald's for $200K because it was too hot.

Our Legal System really needs an enema.

According to the suit the guy seems to be a terrible gambler, what makes him think this "gamble" will work out any better?? ;)

Giorgio_Xo 08-04-2004 11:10 PM

Gary. Move offshore. There is no reason to operate from within the U.S.

frankfortuna 08-04-2004 11:13 PM

Discovery Communications recently had 3.2M seized by the government for accepting advertising money from a Costa Rican outfit.

If you read the lawsuit, it is specifically geared towards websites headquartered in California.

Gary, have your attorney check into the recent WTO decision which ruled that the U.S. (and States) had no right to ban internet gambling because it is considered an internationally accept form of business.

Magg 08-04-2004 11:19 PM

dont forget that people can have accidents.

Basically theyre trying to say that doing something over the Internet is the same as doing it in your hometown. Its an odd concept and one thats not been fully explored legally. If an online casino is in Dublin, is it illegal to access it from CA if gambling is illegal there? I dont think this will go through because the accepted (at least as far as I know and *I AM NOT A LAWYER*) is that such a test does not stand up. If, however, the casino is based in CA, there IS an issue as the business being conducted is relevant to the state laws at hand. *shrug* .02

SmokeyTheBear 08-05-2004 12:55 AM

i always wondered how google / yahoo / overture got away with this sort of thing.. maybe not for long..

ibuydomains 08-05-2004 01:21 AM

i thought being an online gambling player wasnt illegal in California?... just a legal grey-area

Satisfaction 08-05-2004 01:24 AM

really? this is a class action suit, I have a feeling there will be an out of court settlement in favor of the plaintiff . . . what do you think Gary?

TheMob 08-05-2004 01:36 AM

the mcdonalds analogy doesn't even do this justice..

this is like spilling hot mcdonalds coffee and suing everyone that sells coffee, even the coffee farmers in south america. and while he's at it why not sue amazon, i'm sure they sell coffee machines, and coffee table books.

it's more like suing ABC, CBS, FOX for advertising McDonalds coffee....

Gary, you aren't a big player until your company has been sued at least 25 times. You are an expert on lawsuits. Tell your attorneys to kick some ass.

Sexzity 08-05-2004 08:08 AM

This will hit the newspapers all over the world. So you will get a lot more typeins soon

$200k? That old bitty got millions. $20 million plus I think. For some reason, $40 million pops into my head...but I could be off there.

>Actually, what usually happens is that the jury awards some rediculous amount, then in appeals (which you don't hear about) it gets knocked down to about a tenth of the original amount.

For example - I bet everyone knows about the woman who sued McDonald's and won $3mil for hot coffee right? I bet you don't know that a) it was appealed and she got just inder $300k (a far cry from 3mil) b) that particular McD's was written up at least 3 other times for serving coffee too hot c) there were many other complaints on the same thing(too hot coffee) at that location. d) the money she got barely covered her medical bills (she had 2nd and 3rd degree burns in her crotch and had to have several runs of transplant surgery to replace damaged skin....

California seems to make gambling a 'really big deal. I noticed in the slot machine ads on Ebay (even the fake kind) that no one will ship a machine to California..... Many name a few other states - but California is in every add.

The attorney for 2 of the guys suing Gary is Ira Rothken.

In our New Destiny/HomegrownVideo vs CECash/Trade News litigation, he is the attorney for CECash/Trade News.

An all-around scumbag, in my opinion.

Motivated by Indian Casinos, maybe?
