Trump to NFL: Fire Players Who Kneel During Anthem

(Newser) - President Trump says NFL owners should fire players who kneel during the national anthem. And he's encouraging spectators to walk out in protest. In an extended riff during a freewheeling rally speech in Alabama Friday night, Trump also bemoaned that football games have become less aggressive, the AP reports. "They're ruining the game," he complained. Several athletes, including a handful of NFL players, have refused to stand during "The Star-Spangled Banner" to protest of the treatment of blacks by police. Trump says those players are disrespecting the flag and deserve to lose their jobs. "That's a total disrespect of our heritage. That's a total disrespect of everything that we stand for," he said, encouraging owners to act.

"Wouldn't you love to see one of these NFL owners, when somebody disrespects our flag, you'd say, 'Get that son of a bitch off the field right now. Out! He's fired," Trump said to loud applause. Trump also predicted that any owner who went through with his encouragement would become "the most popular person in this country"-at least for a week. Trump, who was in Alabama campaigning for Sen. Luther Strange, also blamed a decline in NFL ratings on the nation's interest in "yours truly" as well as what he described as a decline in violence in the game. He said players are being thrown out for aggressive tackles, and it's "not the same game." But Trump said the anthem protest was the top reason NFL viewership had waned.

Its not freedom of speech. Players have no First Amendment rights while on the field. They are being paid to be there by an employer and that employer has every right to regulate their speech, no different than if you worked at Walmart and wanted to wear your "Fuck the Police" shirt while working.

If they want to protest they can certainly do it when they arent in uniform playing or practicing.

So Trump is correct, these players can be fired, fined, benched or penalized.

I support Kap's right to protest and all the other players joining him - just not on the field while in uniform. Free speech isnt free and Kap is learning that the hard way - as will the other players. Bennett, a black power fist guy, was just fined $9600 by the NFL for a supposed late hit on Rodgers. Im sure that was in response to his letter to the commissioner about November being "Activist Month" in the NFL...

I see facts dont really matter to this group...

Where is Kap's lawsuit vs. the 49ers or the NFL for violating his free speech rights ?

He didnt sue because his lawyer already told him that would get dismissed by the court.

He and the rest of the NFL players that want to protest can do so on their time. These guys can hold press conferences and reporters will show up. They can stand arm to arm in front of police stations all over the US. They can raise money for BLM or any other group they want to... there are a thousand ways to support their cause and further their ideals...

On the field just isnt one of them.

Again, facts. The Constitution only protects governmental infringement on the First Amendment. Kap's protest has nothing to do with free speech, the First Amendment or the Constitution. This has everything to do with employment law. You dont have free speech at work -- unless your employer is the US government or some division of it - state, county or local government.

Public high school football players have more rights to kneel than an NFL player.

You dont like want Trump said, that's great. Im not defending him. I dont like the guy. Im just pointing out the law.

For what may be the first time ever... I agree with trump.

NFL players have a large following and a huge platform for them to convey their message or protest. They have the right to protest, but doing so during the national anthem is nothing more than disrespectful and insulting.

I am a huge 49ers fan - we went to the first game of the season - but fuck Colin Kaepernick. I hope he never plays another football game ever.

Your argument becomes null and void because the point in which they are protesting is during the national anthem which is a salute to the flag of the USA. No employer can force you to salute to any flag..

It would be like being forced to say prayers at work. They would have every right to sue and most certainly would win..

Thats not as clean as an issue you would like it to be. Currently there is no California law on point. There are flag salute cases but those didnt involve a private employer but a public school.

Prayers I think are a much better case. If an NFL team required a Christian invocation by the players before the game then yes, I think you have an easy case there, especially by a Muslim, Jewish person, Atheist, or a person of any other religion.

Kap is an American citizen. As are the other players who are protesting. If they were foreign players, then they would have a reasonable basis to not salute the US flag or stand during the anthem. Then its not a protest. That isnt the case here.

But certain employers can require not only a salute but also a pledge. All lawyers pledge to uphold the Constitution of the US when they are sworn in. If you dont swear to defend the Constitution you simply will not be admitted to practice. All US military members swear the same oath. As do most first responders, judges, political officer holders.

If a Judge refuses to uphold the Constitution as a part of their employment should they still be employed ?

There is a huge difference between people who become part of the judicial/military system, and therefore entrusted to follow and enforce its laws (hence the requirement of a pledge) and athletes that are private citizens.

It would certainly be interesting to see one of these cases go in front of a court with the angle that standing up during the national anthem is a political act.

I agree. I think it would be interesting. I dont think a court would force them to stand but instead make a reasonable accommodation. Perhaps those players wouldnt have to take the field during the national anthem and could remain in the locker room. I dont think the court would force an employer to allow them to kneel and contravene established employment law. That would open a Pandora's box of issues for employers.

Imagine if a performer took a similar position and wanted to wear a tshirt in the scene that the director didnt like that was related to a social or political issue. As a producer you dont want your performers sending their own message in your scenes.

I think what will eventually will happen is that we will see a player's strike over this issue as well as others. That really is their best course of action. Under their CBA with the NFLPA they could force the NFL and owners allow such displays including the shoe displays and other forms of support for different charities and activities.

No but I am an employment lawyer with 20 years experience have represented Boeing, Fox, Universal, Warner Bros, LAPD, LAFD and the LA Dodgers to name a few...

And I have represented performers and directors that have been fired from mainstream jobs because they exercised their First Amendment rights and either performed in or directed porn.

NFL players have the constitutional right to protest the anthem if they wish. The government cannot stop them from doing so nor can the government arrest them for doing so. However, the NFL is not required to employ them or accommodate them so if they do it, and they end up in a place like Kap where nobody wants to hire them, then that is the price they are paying for their actions.

Free speech is guaranteed in this country, but it is not absolute.
