Headway is released under the GPLv2. Right from their site. If you purchase this from them you have certain rights as per the GPL.

And these guys know he's well within his rights too. Check out how they word their ToS. No mention of the actual software, but the service. You're paying to access the download updates and the support. Because GPLv2 let's everyone do what they want with the code.

It has been pointed out to you. The only thing they can do is cut off his access to updates and support, because that's all the GPL and their ToS allow them to do.

The people you contacted are saying that because they either don't understand the license they have released their software under or just have sour grapes because they don't like the situation they are forced into if they want to put something out for Wordpress. The WP organization did force them into this arrangement.

That is a two year old blog post and is basically a rant against exactly what I am talking about. He doesn't like that Wordpress is forcing something on him.

I'm posting their CURRENT Terms of Service which is what anyone giving them money is agreeing to and again, mentions nothing of a split license and only GPLv2. You don't think it's possible that in the 2 years they've decided to play by the rules that Wordpress has laid out.

Again their current ToS states that all Headway themes are GPLv2. I'm not concerned with what a 2 year old blog post states, it's the Terms of Service and based on that fris was certainly within his rights to do what he did, and they were within their rights to cancel his service. That's about it.

If that was the case, don't you think it would mention a split license SOMEWHERE ON THEIR SITE? The only place it shows up is on a rant he posted on someone else's blog. Multiple times on the Headway Themes site does it mention the GPLv2.

Sorry man. Regardless of what he says, you haven't shown us anything that proves this while I'm showing you plenty of evidence on THEIR OWN SITE that they are releasing their code under GPLv2. This means fris was well within his rights to do what he did. And that's not taking into account that he paid them more for developer rights and access, which ALSO gives him the right to allow his "clients" to make use of these on their sites.

The only thing they can do is cancel his account, again as per their terms. But that's about it. Sour grapes because they are forced into this license by Wordpress.

And no one is debating the GPL really, at this point it's whether or not a script was released under the GPL or not.

And I still stand on what I say. You can search Google and pull up the Headway split license stuff until you're blue in the face, and it doesn't change the fact that the ToS and every point of mention on the website they are selling the script on and collecting people's money says that the "All Headway Themes are released under the GPLv2". A 2 year old rant on a blog by the kid who wrote the code's dad doesn't change that.
