These statutory rape laws historically started to stop seduction of naive, innocent children by predatory adults. In most of the early laws, including that of Illlinois, it was necessary for the state to prove that the child had been of previously chaste character. As late as 1976, it was a complete defense in Illinois that the female was a prostitute. Illinois law took the position that the horse was out of the barn in that case, that there was no longer anything to protect.

Over time, the political activists took the position (not concurred with by the medical health professionals defining pedophilia in the DSM III and IV) that it was perverted for a man to be attracted to females under the statutory age of consent and that the females were all victims of one or another male sex organs, and so the limiting language or the defense of prostitution were removed. So the law is now more absolute.

The age of consent varies in complicated ways around the US. 16 is the age in Michigan, 17 in Illinois, and 18 in Wisconsin. In some states, the difference in age between the parties makes a difference, in others not at all. In most states, it is an affirmative defense that the adult reasonably believed the child to be an adult. In others, including Florida, this is no defense at all, not even if the child is brandishing a phony ID that tends to establish that she's 18.

Until very recently, Switzerland permitted prostitution at age 16 and online ads for massage parlors advertised such ages. International pressure caused this to change. In many nations, the family of the child can pardon the offense, leading to marriage or a financial settlement to avoid criminal charges.

US Federal law criminalizes international travel by US passport holders for sex with persons under specified ages, regardless of whether such sex is legal at the place where it takes place. And this law is enforced.

There is nothing close to uniformity among the nations or states in this sensitive area.

But, germane to the purposes of this forum, understand while that it may be entirely legal to commit consensual sodomy with a 16 year old for days on end in some jurisdictions, one photograph of her breasts is enough to put you in prison and on a sex offender registry for the rest of your life.
