I think you need to rethink how you are doing this popup. At the moment it is very confusing and will probably lose you traffic. On the internet, I would advise keeping things as simple and clear as possible.
I would say if you need an age verification pop-up, then have just that, i.e. a very simple age verification first. Then worry about how you will sell the premium service in a separate mechanism. At the moment, the pop-up is too much.
